Homeasy Terms of Service

Welcome to Homeasy (“Homeasy,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Homeasy websites, web and mobile apps, browser extensions, widgets, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

1) Eligibility & Accounts

  • You must be at least 18 and able to form a binding contract. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
  • Provide accurate account information and keep it current. You are responsible for all activity under your account and for safeguarding your credentials.
  • We may offer “Personal,” “Pro/Trade,” and enterprise accounts with different features and limits.

2) What Homeasy Does

Homeasy enables users to create moodboards, import or clip images (including from services like Pinterest, Google Drive/Photos, Instagram, or via URL), generate AI-assisted room designs, and discover shoppable components matched to those designs via links to third-party retailers, brand partners, or affiliate programs.

3) We Are a Marketplace; Not the Seller of Third-Party Goods

  • Homeasy does not manufacture, sell, ship, or warrant third-party products. Purchases are made directly from third-party merchants or partners (“Merchants”).
  • Product availability, pricing, taxes, shipping, returns, warranties, compliance, and customer service are handled by the Merchant under its terms and policies. Disputes regarding a purchase must be resolved with the Merchant.
  • Disclosure: Homeasy may earn commissions or other compensation from qualifying purchases through affiliate links and partner programs.

4) Plans, Billing & Taxes

  • Subscriptions. Some features require a paid subscription. Unless otherwise stated, plans auto-renew until canceled.
  • Billing. You authorize us (and our payment processor) to charge your payment method for subscription fees, add-ons, and applicable taxes. Failed payments may result in suspension.
  • Price Changes. We may change pricing with reasonable notice; changes apply on your next billing cycle.
  • Cancellations. You can cancel at any time in your account settings; access continues through the end of the paid term. Unless required by law, fees are non-refundable.
  • Taxes. You are responsible for any sales, use, VAT, GST, or similar taxes.

5) Trials, Promotions & Beta Features

  • Trials convert to paid unless you cancel before the trial ends.
  • Promotions may have additional terms.
  • We may offer “Labs” or beta features. These are provided “as is,” may change or end at any time, and may be subject to additional terms.

6) Your Content (Uploads, Pins, Moodboards)

  • Ownership. You retain ownership of images, text, videos, pins, and other content you upload or create (“User Content”).
  • Responsibility. You must have all necessary rights to your User Content and you are solely responsible for it, including ensuring it does not infringe, violate law, or contain personal data you do not have rights to share.
  • Removal. You can delete your User Content at any time; copies may persist in routine backups for a limited period.
  • Public Sharing. If you choose to publish moodboards or designs publicly (e.g., community galleries), you grant other users permission to view, save, and share links to that content, consistent with the sharing settings you select.

7) Licenses You Grant to Homeasy

You grant Homeasy a worldwide, non-exclusive, royalty-free license to host, store, process, adapt, reproduce, and display your User Content solely to operate, improve, and provide the Services (including AI processing, thumbnails/previews, caching, content moderation, and backup). If you set content to be public, you also grant Homeasy the right to display it publicly and to promote your public content in and about the Services. This license ends when your User Content is deleted from our systems, subject to normal backup retention and legal holds.

8) AI Features & Generated Output

  • Output. The Services may generate designs, layouts, product matches, descriptions, and other material (“AI Output”). Subject to these Terms, we assign to you all right, title, and interest we may have in AI Output generated for your prompts, to the extent permitted by law. You are responsible for reviewing AI Output for accuracy, compliance, and suitability.
  • Non-deterministic. AI Output may be incorrect, incomplete, or produce similar results for different users. Do not rely on AI Output for structural, safety-critical, or code-compliant specifications; consult qualified professionals where appropriate.
  • Training/Improvements. We may use de-identified usage data to improve the Services. You can email [privacy@homeasy.example] to request an opt-out where available.

9) Acceptable Use

  • No infringing, defamatory, deceptive, fraudulent, harassing, obscene, or otherwise unlawful content.
  • No scraping, rate-limiting abuse, reverse engineering (except to the extent permitted by law), or unauthorized access.
  • No uploading of malicious code or attempts to bypass security.
  • No unauthorized commercial exploitation of the Services or creation of a competing dataset from the Services.
  • Respect others’ privacy; do not upload personal data of others without permission.

10) Intellectual Property; DMCA

  • The Services, including the Homeasy name, trademarks, logos, software, and design templates, are owned by Homeasy or its licensors and are protected by IP laws. Except for the limited rights expressly granted, we reserve all rights.
  • DMCA Notices. If you believe content on the Services infringes your copyright, send a notice to our designated agent: [DMCA Agent Name], [Address], [City, State, ZIP], [Email], [Phone]. Your notice must include the information required by 17 U.S.C. §512(c)(3). We may disable or remove allegedly infringing content and, where appropriate, terminate repeat infringers.

11) Third-Party Services, Links & Partners

  • The Services integrate with or link to third parties (e.g., Pinterest, Google Drive/Photos, Instagram, payment processors, Merchants). Their terms and privacy policies govern your use of those services.
  • We are not responsible for third-party content, products, or services. Your dealings with third parties are solely between you and them.
  • We may display product data, pricing, and availability received from partners; such information can change without notice and may not be real-time.

12) Privacy

Your use of the Services is also governed by the Homeasy Privacy Policy. You consent to the collection and use of your data as described there.

13) Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ANY AI OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HOMEASY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR MEET YOUR REQUIREMENTS.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOMEASY, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR AI OUTPUT. HOMEASY’S TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE AMOUNT YOU PAID TO HOMEASY IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15) Indemnification

You will defend, indemnify, and hold harmless Homeasy and its affiliates, officers, agents, and employees from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Services; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

16) Suspension & Termination

  • We may suspend or terminate your access if we reasonably believe you violated these Terms or pose a risk to the Services or others.
  • You may stop using the Services at any time. Upon termination, Sections 6–8 and 10–19 survive.

17) Governing Law; Arbitration; Class-Action Waiver

These Terms and any disputes will be governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer rules, on an individual basis. Class actions and class arbitrations are not permitted. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

18) Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms with the “Last updated” date above and, if material, provide additional notice. Changes take effect upon posting unless otherwise stated. If you continue to use the Services after changes become effective, you accept the new Terms.

19) Miscellaneous

  • Entire Agreement. These Terms, together with any supplemental terms and our Privacy Policy, constitute the entire agreement between you and Homeasy.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
  • No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
  • Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.

If you are a resident of the European Economic Area, United Kingdom, or Switzerland, you may have additional consumer rights under local law. Nothing in these Terms is intended to limit statutory rights that cannot be limited by contract.
